1 - ONLINE CONTRACT SUBJECT AND ITS DEFINITION
As “on line contract” we mean an online agreement about movables and/or services between Medianet srl, Tortoretoi, Italy-based in Via Nazionale 166, and a consumer in a distance sale system organised by the supplier. All contracts will be finalized by entering the web-site www.volleyshop.biz where the customer-consumer, following the instructions, will be able to conclude the sale contract. As “customer-consumer” we mean the natural or legal person purchasing the offered goods/movables or services. Herewith, the terms of sale which will remain so till the supplier changes them. Their possible adjustments will be operative from the moment of their publication in the “www.volleyshop.biz." web-site and will refer to the sales made from that moment forth.
2 - SALE PRICES AND PURCHASE PROCEDURES
All the sale prices of the products listed in the www.volleyshop.biz web-site represent a public offer according to the clause of article 1336 italian civil code and are VAT included; transport costs are automatically calculated when the goods order is complete; transport costs are fixed for each package sent. The purchase contract is finalized at the online correct compilation and purchasing consensum. The customer can pay the ordered goods using the terms of payment indicated on purchasing.
3 - CONTRACT EXECUTION AND DELIVERY TERMS
Medianet S.r.l. will deliver the ordered products to the customers, according to the previous clause, by trust couriers. The delivery time of the stock products may vary from the ordering day to a maximum of 8 working days and, in any case, it will not exceed the period indicated in clause 6 Decr. Legisl. 185/1999 italian law (30 days from the ordering date). The supplier will not be responsible for a delayed or failed delivery due to fortuity or circumstances beyond our control.
4 - RESPONSIBILITY
Medianet S.r.l. will not be responsible for inefficiencies due to circumstances beyond our control such as accidents, explosions, strikes or lock out, earthquakes, floods and similar events which may prevent in total or in part the conclusion of the contract in the time agreed. Medianet S.r.l. will not be responsible towards any part for damages, losses or costs due to the failed execution of the contract according to the above mentioned causes. The consumer has only the right of getting compensation of the paid price. Medianet S.r.l. will not be responsible for any possible fraudulent or illegal use of credit cards, cheques, and other payment means made by the third party on paying the purchased products.
5 - WARRANTIES AND AFTER-SALE SERVICE
Medianet S.r.l. sells high quality products and offers the same warranty given by the products manufacturer. Anyway, the related norm and the terms of warranty are those indicated and highlighted by the manufacturer in the attached certificate.
6 - BUYER’S DUTIES
Once concluded the “on line” sale procedure, the buyer is bound to provide for the printing and the preservation of these general terms of use and the purchased product features in order to satisfy the clauses no. 3 and no. 4 of the Decr. Legisl. N.185/1999 italian law. It is strictly forbidden the buyer to fill untrue and/or invented and/or fantasy data in the contract and related communications; personal data and email address must be real buyer personal data not third party’s or fantasy data. Medianet S.r.l.reserves to prosecute the buyer for every violation and abuse according to the consumer protection.
7 - WITHDRAWAL RIGHT
If the consumer is not satisfied with the purchase made, he has the right to revoke the purchase contract without giving reasons and having penalties, within 10 working days starting from the day of the goods receipt. The revoke must be sent within the above mentioned 10 days through a registered letter with return receipt to the following address: Medianet S.r.l. Via Nazionale 166- 64018 Tortoreto- Italy. Within the same period the consumer may send a telegram or a fax followed by the above mentioned registered letter with return receipt, to confirm the withdrawal will. Within the above mentioned period of 10 days all purchased products must be sent back intact in their original package, with their own manuals (if present) and without any lack, to Medianet S.r.l.. The customer will pay the return costs. Once the goods received, Medianet S.r.l.will provide to return the whole amount paid by the consumer within 30 days. If the amount is paid by cash on delivery, Medianet S.r.l. will provide to credit the amount, cashing costs deducted, by nonnegotiable cheque or bank transfer on customer account.
8 - RESCISSION OF THE CONTRACT AND LET-OUT EXPRESSED CLAUSE
Medianet S.r.l. may rescind the contract informing the customer with appropriate reasons. In this case, the customer has only the right of having back the already paid amount. The customer’s obligations according to the no. 7 clause and the well-ended payment by using means detailed in no. 2 clause are essential, and any customer’s breach will cause the rescission of the contract, according to the ex art.1456 italian civil code, without court pronouncement. Medianet S.r.l. has the right to take legal action in order to compensate any other damage.
9 - PERSONAL DATA TREATMENT
Personal data are used only to register the customer and fulfil the contract and its related communications. Personal data treatment follows the low in force and the data themselves may be produced only if requested by the judiciary authority. Only the parties involved in the contract execution are informed about personal data which are used exclusively for this purpose. According to the art. 13 L.675/1996, italian law, the person involved has the following rights: - To ask for the confirmation of the existence of his/her own data; - To know the data treatment aims, their origin and logic; - To obtain their actualization, change and integration; - To ask for their cancellation, transformation in anonymity or their blockage if illicitly used; - To oppose to their treatment according to reasonable causes; - To oppose to their treatment if they are used to send advertising material, sales information, market surveys, direct selling and interactive sale communications. Medianet S.r.l. Via Nazionale 166 - 64018 Tortoreto- Italy, is responsible for the collection and treatment of personal data.
10 - PLACE OF JURISDICTION
Any dispute regarding the application, execution, interpretation and violation of the sale contract, on line finalized by entering the web site www.volleyshop.biz, is under the Italian jurisdiction. The hereby general terms of use refer to the order in council italian law n.50 dated 15.01.1992 and n.185 dated 22.5.1999. For any other dispute among the parties regarding the present contract, the place of jurisdiction will be the one where the consumer has the domicile if located in Italian territory; for all other customers, the place of jurisdiction will be Teramo Jurisdiction.
